By using our LIFEWARES website, users agree to accept the following Terms & Conditions.
1. USER AGREEMENT:
Users agree: (a) This agreement is formed between LIFEWARES ONLINE and the user; (b) Not to use the LIFEWARES website if the user does not agree with any Terms & Conditions; (c) To maintain user identification, password and other information relating to your LIFEWARES Membership (“Account”); (d) To be responsible for all matters resulting from use of your account and use of your account by any other unauthorised user; (e) To notify LIFEWARES immediately if you become aware of any unauthorised use of your account; (f) That the username and password is used by the registered individual only and is not transferable to any other party.
Registration is not required for users to access products offered by LIFEWARES.COM.AU. User registration is optional; users can register by completing their registration details as described on LIFEWARES.COM.AU. LIFEWARES reserves the right to terminate a user’s membership if the user breaches our Terms & Conditions. Users must ensure that their registration details are true and accurate. Users must notify LIFEWARES of any change to their registration details. Upon registration, users are to create their own username and password.
3. CHANGES or UPDATES:
LIFEWARES Terms & Conditions are subject to change without notice. Any changes or updates will be effective immediately. The continued use of the LIFEWARES website will be deemed as the User’s acceptance of the updated Terms & Conditions.
4. EMAIL POLICY:
Registered User’s agree to receive promotional, marketing and newsletter emails from LIFEWARES. Users consent to receiving such material and can opt out at any time.
5. THIRD PARTY WEBSITES:
The LIFEWARES website may contain links to other websites. This does not imply that LIFEWARES endorse nor support the contents of third-party websites. Users are advised to review the terms & conditions and privacy policies of third-party websites. LIFEWARES cannot guarantee any programs or data available for download on this website or any linked third-party website is free of viruses or spyware. The user agrees that you assume the risk of any damage to your computer as a result of using this website.
(a) Product specifications are subject to change without notice. Information about products listed on LIFEWARES is based on material provided by manufacturers and suppliers. Users agree that except as required by law, LIFEWARES cannot be held accountable for any inaccuracies or mistakes resulting from incorrect information supplied by manufacturers or suppliers. (b) Users need to make their own assessment of product information provided to ascertain the suitability of items, before an order is placed. If you are unsure, please contact LIFEWARES for more information. (c) Images on the LIFEWARES website are for illustration purposes only. In some cases, actual products may vary slightly. (d) LIFEWARES reserves the right to change or remove any product offer or information from the website without notice. (e) LIFEWARES reserves the right to cancel any orders for products that are no longer available or manufactured. A full refund for cancelled orders will be charged back to the original payment account. LIFEWARES will not be liable for any additional costs borne by the user having to purchase a product from another retailer at a higher price.
7. PRODUCT AVAILABILITY:
LIFEWARES will endeavour to ensure all products listed on our website are available to order. In most cases we will notify you if a product becomes unavailable before placing an order. In some cases this is not possible. LIFEWARES may need to cancel your order if the item has become unavailable. LIFEWARES will refund in full all amounts paid for orders of unavailable product. LIFEWARES will not be liable for any additional costs borne by the user having to purchase a product from another retailer at a higher price.
(a) Users can place orders for product on the LIFEWARES website. (b) Orders placed are a commitment to purchase, so please choose carefully. (b) LIFEWARES reserves the right to accept or reject orders for a product at any time prior to dispatch. Any orders cancelled by LIFEWARES will be refunded in full by way of charge-back to the user’s original payment method. LIFEWARES will not be liable for any additional costs borne by the user having to purchase a product from another retailer at a higher price.
All product pricing is listed in Australian dollars. All pricing on the LIFEWARES website include GST. All prices are subject to change without notice. Orders will only be dispatched once payment has been received in full.
10. DELIVERY & SHIPPING:
(a) We do our best to ensure all orders are delivered within the stated time-frames advised by our carriers and suppliers, see "Shipping Information". LIFEWARES however cannot guarantee that time-frames will be met without any delays. There are sometimes factors beyond our control that can impact on the delivery of your order. LIFEWARES will endeavor to keep you up-to-date through communication and track & trace tools provided by our carriers and suppliers. (b) Deliveries fulfilled on behalf of LIFEWARES will occur during normal business hours between 9am - 5pm, Monday to Friday. Please note: We do not ship to PO Box addresses or offer PICK UP from LIFEWARES. (c) Once your order has been dispatched, LIFEWARES will provide a tracking number for users to communicate with the carrier for date and time of your delivery. LIFEWARES may ship your order in multiple shipments from different distribution locations. In this case, you will receive multiple shipping confirmation emails from us, all containing your separate Track & Trace information.
11. TITLE AND RISK:
The title of goods passes to you upon payment for the products in full. Risk in products passes to you upon delivery to your nominated delivery address.
12. CHANGE OF MIND RETURNS:
(a) If you wish to cancel your order prior to dispatch please contact us as soon as possible. In the event your order has already been dispatched and you still do not wish to keep the item, you can return the goods for a full refund provided it meets the criteria listed below and found in our “Returns Policy”. Postage charges for all returned goods will be at the cost of the purchaser (User) A 20% re-stocking fee for returns because of “change your mind” will also apply. Change of mind returns must be actioned within 14 days of purchase date. We do not offer change of mind on personalised items. A list of items that do not qualify for change of mind returns can also be found in our “Returns Policy”
Items that qualify for returned goods must;
- Not be used or worn and with original tags and packaging;
- Not damaged in any way and in perfect sale-able condition;
- Returned with all accessories and parts as originally supplied/delivered.
- Provide proof of purchase. (receipt or order number)
After you contact LIFEWARES we will ask you to follow our returns procedure. Any returns received without prior contact or approval will be rejected. LIFEWARES will provide you with a RMA (Return Merchandise Authorisation) number.
(b) LIFEWARES will provide you with a store credit or refund (minus the re-stocking fee) only when the returned product is received and checked by a LIFEWARES team member. You are responsible for the return shipping costs of your change of mind order.
The LIFEWARES website provides all content on an "as is" basis, we make no representation as to the accuracy and completeness or reliability of the information contained on the website. LIFEWARES will not be liable in contract, tort (including negligence) or otherwise, to you for any direct, special, indirect or consequential loss or damage, including loss of profits or loss of data arising out of the use in connection with our website.
14. DEFECTIVE or DOA GOODS:
(a) Under Australian Consumer Law. You are entitled to a replacement or refund for a major product failure. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. (b) To raise a claim please email [email protected] and provide proof of purchase (receipt or order number). To assist with your claim, you will need to describe in accurate detail the problems you have encountered and provide evidence (photograph or video) to support your claim. Please also state whether you are requesting a replacement, repair, credit or refund. A LIFEWARES customer service team member will then be in contact with you to determine on the facts you have provided, if you are eligible for a claim and if so we will ask you to follow our returns process. (c) Some products purchased from LIFEWARES will contain warranty documents provided by the manufacturer. Any manufacturer warranty documents are not related to LIFEWARES. Manufacturer warranties are separate to any warranty given to you by LIFEWARES. Some warranties on imported goods may not apply in Australia. You can contact the manufacturer on the warranty document to determine whether the warranty applies in Australia and, if so, how you should go about making a claim. (d) Before taking delivery of a parcel we recommend inspecting the parcel to ensure all the items are in good condition. In case of breakage please contact LIFEWARES immediately. Please email LIFEWARES a photo of the damaged item and the order number so that we can lodge a claim with the delivery service.
Our standard manufacturer warranty period is 12 months.
